Terms of Service
The terms that apply when you create a CogniStride account or use the service.
1. Agreement
These Terms of Service (“Terms”) are an agreement between you and Natural Health Logic Global (“we”, “us”), which operates CogniStride. By creating an account or using CogniStride you agree to these Terms and acknowledge our Privacy Policy.
2. What CogniStride is, and is not
CogniStride is a web application for practising and documenting cognitive rehabilitation exercises. It is not a medical device and does not diagnose, screen for, treat, cure, monitor or prevent any disease or condition. Scores and summaries produced by CogniStride, including suggested levels and SOAP note drafts, are not validated clinical measures and must be reviewed by a qualified professional before being relied on. CogniStride does not replace assessment, advice or care from a qualified professional. In an emergency, call your local emergency number.
3. Accounts
- You must be at least 18 years old, or have a parent or guardian create and supervise the account.
- Provide accurate information and keep your password secure. You are responsible for activity under your account.
- Each account is for one person. Clinician accounts may not be shared between clinicians.
4. Clinicians’ responsibilities
If you use CogniStride with patients or clients, you are responsible for your professional judgement about its use, for obtaining any consent required, for the accuracy of what you record and document, and for complying with the laws, regulations and professional standards that apply to you and your organisation, including those about health information and record keeping.
5. Patient information on your device
Patient information you enter is stored in the browser on your device and not on our servers (see Where patient data lives). We cannot access, back up or recover it. You are responsible for keeping that device secure and for making any backups you need. Clearing browser data, using a different device or browser, or browser or device failure can result in loss of that information.
6. Subscriptions, trials and billing
- Plans. Current plans and prices are shown on the pricing page. Features differ by plan.
- Free trial. New accounts may start one free trial of 14 days. A payment method is required. Unless you cancel before the trial ends, your subscription begins and you will be charged automatically.
- Renewal. Subscriptions renew automatically each month or year, depending on the billing interval you choose, until cancelled.
- Payments. Payments are processed by Stripe. You authorise us, through Stripe, to charge your payment method for subscription fees.
- Changes and cancellation. You can change plan or cancel at any time from Account → Manage billing. Cancellation takes effect at the end of the current billing period, and access continues until then. Plan changes may be prorated.
- Refunds. Fees already paid are non-refundable except where required by law.
- Price changes. We may change prices with advance notice. Changes apply from your next billing period after the notice.
7. Acceptable use
You agree not to misuse CogniStride, including by attempting to access it without a valid subscription, interfering with its security or operation, reverse-engineering it except where the law allows, reselling or redistributing it, or using it in violation of any law.
8. Intellectual property
CogniStride, including its software, exercises, content and design, is owned by us or our licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use CogniStride during your subscription in line with these Terms. You keep ownership of the information you enter.
9. Third-party services
CogniStride relies on third-party services such as Stripe for payments and browser features such as speech synthesis and speech recognition. Their availability and behaviour are outside our control and are subject to their own terms.
10. Availability and changes
We work to keep CogniStride available but do not guarantee it will be uninterrupted or error-free. We may change, add or remove features. If we discontinue a paid feature you rely on, we will give reasonable notice where practicable.
11. Disclaimers
To the extent permitted by law, CogniStride is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data (including patient information stored on your device), profits or goodwill. Our total liability for any claim relating to CogniStride is limited to the amount you paid us in the 12 months before the claim.
13. Termination
You may stop using CogniStride and cancel at any time. We may suspend or end your access if you materially breach these Terms or if required by law. Sections that by their nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Georgia, unless the law of your place of residence requires otherwise.
15. Changes to these Terms
We may update these Terms. We will change the “last updated” date and, for material changes, notify account holders in advance by email or in the product. Continuing to use CogniStride after changes take effect means you accept them.
